Acceptance of Terms
By downloading, installing, or using AIR Client ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.
AIR Client is provided by the AIR Client development team ("we," "us," or "our"). These Terms constitute a legally binding agreement between you and AIR Client regarding your use of the Software and any related services, including our website, Discord server, and API services (collectively, the "Services").
We reserve the right to update these Terms at any time. We will notify users of material changes through the AIR Client Discord server and the client's Home screen. Your continued use of the Software after changes are posted constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for updates.
Use License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use AIR Client on your personal devices for your personal, non-commercial use.
This license does not grant you any ownership rights in the Software. We retain all rights, title, and interest in and to AIR Client, including all intellectual property rights. The Software is licensed, not sold.
AIR Client is provided free of charge. We reserve the right to offer premium features, cosmetics, or subscriptions in the future. Any such offerings will be clearly communicated and will be entirely optional.
You are responsible for ensuring that your use of AIR Client complies with Minecraft's End User License Agreement (EULA) and any applicable server rules. AIR Client is a launcher — it is your responsibility to use it in accordance with the terms set by Mojang Studios and Microsoft.
Restrictions
You agree that you will not, under any circumstances:
- Modify, reverse engineer, decompile, or disassemble any part of the Software, except as expressly permitted by applicable law.
- Distribute, sublicense, rent, lease, or sell access to the Software or any part of it to any third party.
- Use the Software to develop, distribute, or facilitate cheats, hacks, or any unauthorized modifications that violate the integrity of Minecraft or any multiplayer server.
- Use the Software for any illegal purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to our servers, APIs, or any systems connected to the Services.
- Use the Software to harass, abuse, or harm other users, or to distribute malware, viruses, or other harmful code.
- Impersonate AIR Client staff, moderators, or any other person or entity.
- Remove, obscure, or alter any copyright notices, trademarks, or other proprietary notices displayed in the Software.
Violation of any of these restrictions may result in immediate termination of your license, at our sole discretion, without prior notice.
Intellectual Property
AIR Client, including its name, logo, design, user interface, source code, and all related assets, is the exclusive intellectual property of the AIR Client development team. All rights not expressly granted in these Terms are reserved.
The AIR Client name and logo are trademarks of the AIR Client project. You may not use these marks without our prior written permission, except for the purpose of identifying or referring to the Software in a fair and non-deceptive manner.
Minecraft is a registered trademark of Mojang Studios and Microsoft Corporation. AIR Client is an independent project and is not affiliated with, endorsed by, or sponsored by Mojang Studios or Microsoft.
Third-party mods, resource packs, and content accessed through the Software remain the intellectual property of their respective authors. AIR Client does not claim ownership over user-created content or third-party modifications.
User Content
You retain all ownership rights to the content you create, upload, or configure within AIR Client, including but not limited to mod configurations, profiles, server lists, and cosmetic selections ("User Content").
By using the cloud sync feature, you grant us a limited license to store and transmit your User Content solely for the purpose of providing the sync functionality. We do not review, moderate, or claim ownership over your User Content.
You represent and warrant that your User Content does not violate any third-party rights or applicable laws. You are solely responsible for your User Content and any consequences of sharing or syncing it.
If you choose to share mod packs, profiles, or configurations publicly through our platform, you grant other users a license to use that content in accordance with these Terms.
Termination
These Terms remain in effect until terminated by either party. You may terminate these Terms at any time by uninstalling AIR Client and ceasing all use of the Services.
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, if:
- You violate any provision of these Terms.
- Your conduct creates risk or possible legal exposure for us or other users.
- We discontinue the Services (in whole or in part).
Upon termination, your right to use the Software ceases immediately. You must uninstall and delete all copies of AIR Client from your devices. Sections of these Terms that by their nature should survive termination (including Disclaimer, Limitations, Intellectual Property, and Governing Law) will survive.
Disclaimer of Warranties
THE SOFTWARE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Software will meet your specific requirements or expectations.
- The Software will be uninterrupted, timely, secure, or error-free.
- Any errors or defects in the Software will be corrected.
- The Software is free of viruses or other harmful components.
AIR Client is in active development. Features may change, be removed, or be added without notice. The Software may contain bugs, incomplete features, or other issues. By using AIR Client, you acknowledge and accept these risks.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AIR CLIENT DEVELOPMENT TEAM, ITS CONTRIBUTORS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, profiles, mods, or configurations.
- Loss of revenue, profits, or anticipated savings.
- Damage to your computer system, hardware, or software.
- Personal injury or property damage.
- Any other damages arising out of or in connection with your use of or inability to use the Software or Services.
This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
In jurisdictions that do not allow the limitation of liability for certain damages, our total liability to you for all claims arising out of or relating to these Terms or the Software shall not exceed the greater of (a) the amount you paid us for the Software (which is zero, as the Software is provided free of charge), or (b) fifty United States dollars (USD $50.00).
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Software shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Wilmington, Delaware. You agree to submit to the personal jurisdiction of the courts located in Delaware for the purpose of litigating any claims that are not subject to arbitration.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms constitute the entire agreement between you and AIR Client regarding your use of the Software and supersede any prior agreements between us on the same subject.
